Personal Account – Terms of service

Peers provides the service Peers.me (“Service”) to users (“Users”). Use of the Service is provided to you, the User, subject to the following terms of service agreement (“Terms”), which may be updated by us from time to time. You (the “User”) by using the Service, agree to be bound and abide by the terms and conditions of this Agreement with Peers.

  1. OVERVIEW: You agree that you will only use the Service as a User if you are a person over 12 years of age. You agree that you will not store, copy, modify, rent, lease, loan, sell, distribute, transfer, transmit, display, reverse engineer, reverse assemble, or otherwise attempt to discover any programming code or any source code used in or with the Service. You may not sell, assign, sub-license, grant a security interest in or otherwise attempt to transfer any right in the Service (which includes its software and documentation), create derivative works based on or in any manner commercially exploit the Service, in whole or in part. You agree that violations by you, any other person or entity, of these copyrights, trade secrets, patents, other intellectual property protections, or the terms of this Agreement will be prosecuted to the fullest extent of the law in courts located in The Netherlands. The Service are offered on an “as is” basis and used by the User solely at his or her own risk. All user-specific information provided by the User in connection with Service shall be used to provide services and features to the User and to maintain the associated websites.

  2. USER CONDUCT: Peers holds the User responsible for all content that is shared or published in the Service by the User. Peers does not allow any of the following content, or links to such content, to be published on the Service:

    • Content of a pornographic, sexually explicit, or violent nature.
    • Content of an illegal nature (including stolen copyrighted material).
    • Pirated software sites, including cracking programs or cracking program archives.
    • Content with the sole purpose of causing harm or inciting hate, or content that could be reasonably considered as slanderous or libelous.
    Users posting any of the above content on their sites will be notified using User’s current email address on file, and given a 48-hour grace period to make any corrective actions. If no corrective actions are taken, Peers will suspend the service of the User account until a resolution is met between Peers and the User. A repeated violation of this Policy may cause cancellation of service without refund of any fees.

In addition, Peers does not allow any of the following:

  • Users may not use the Service as a remote storage server only.
  • Users must exercise caution when hosting large downloads (>10MB). Peers reserves the right to refuse to host any large downloadable files.
  • Users may not send unsolicited messages (also known as junk mail or SPAM) to promote any website published on the Service.
Users deemed to be using Peers solely as a remote storage server will have their account immediately terminated and will have all files associated with their account permanently removed.

The final choice of whether an account is in violation of any of these policies is at the sole discretion of Peers.

Violation of any of these policies may result in tracking information being stored to identify the offending user, and permanent restriction from holding an account on the Service.

  1. FEES:
    • Peers.me starts as a free service. If you like what you see, we ask you to make a donation and keep this service free of advertising.
    • Peers is allowed to introduce a pricing model and change fees for usage of Peers.me at any given moment.
  2. CONTRIBUTED CONTENT: We do not claim ownership of content you submit or make available (“Contributed Content”) for inclusion in the Service. If you contribute content that does not constitute your original work of authorship as defined under Dutch Copyright Law, but a third party holds the copyright and other proprietary rights to such content, you represent and warrant to Peers that you do not infringe on any third party’s copyright or other proprietary rights and that you have secured all necessary permissions and licenses prior to contributing such content to the Service.

  3. PUBLISH: User acknowledges that Contributed Content can be exposed out of the Service via it’s API by every User contributing to the content, depending on the permission level of the User that contribute on the content. Further, User acknowledges that the Contributed Content and other communications are not endorsed by Peers and such communications shall not be considered reviewed, screened, or approved by Peers. Peers reserves the right for any reason to remove without notice any Contributed Content from the Service.

  4. PEERS ACCOUNT AND USE OF SERVICE: When creating an personal account on Peers.me, you are responsible for maintaining the security of this account and all activities that occur under the account. You must immediately notify us of any unauthorized uses of your account by email us at support@peers.me. We will not be liable for any acts or omissions by any user, including any damages of any kind incurred as a result of such acts or omissions. You also agree that you will provide only truthful information in your user profile.

  5. PRIVACY: By accepting these Terms you also accept the Peers.me Privacy Policy, which can be read online at http://www.peers.me/privacy-policy.

  6. DISCLAIMER OF WARRANTIES: While Peers endeavors to provide current and accurate information, SITE CONTENT IS PROVIDED “AS IS” AND “AS AVAILABLE”. PEERS DOES NOT WARRANT THE AVAILABILITY OF PEERS.ME NOR THE ACCURACY, COMPLETENESS, OR CURRENCY OF THE SERVICE CONTENT OR ANY MATERIAL PROVIDED THROUGH THE PEERS.ME AND DOES NOT WARRANT THAT PEERS.ME OPERATES ERROR-FREE, NOR THAT DEFECTS, ERRORS OR OMISSIONS WILL BE CORRECTED OR THAT THE PEERS STARTER IS COMPLETELY SECURE. PEERS EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO IMPLIED, EXPRESS OR STATUTORY WARRANTIES AS TO NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, OR THIRD PARTY RIGHTS, TITLE, LATENT DEFECTS, UNINTERRUPTED SERVICE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND FREEDOM FROM COMPUTER VIRUSES.

  7. DISCLAIMER OF LIABILITY: IN NO EVENT WILL PEERS BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, DIRECT OR INDIRECT, SPECIAL INCIDENTAL, MORAL OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, OPPORTUNITIES OR INFORMATION OR FOR EXPENSES ARISING IN CONNECTION WITH YOUR USE OF THE SERVICE OR THE SITE CONTENT, EVEN IF PEERS IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, LOSSES OR EXPENSES.

  8. DISCLAIMER OF ENDORSEMENTS: The Service contains links to third-party web sites. The linked sites are not under the control of Peers, and Peers is not responsible for the contents of any linked site or any link contained in a linked site. The appearance on the Service of the name or logo of another entity, or the appearance of a link to another entity’s site, does not indicate endorsement or referral by Peers of the other entity or its products and service, and Peers expressly disclaims any such endorsement or referral.

  9. CONTRACT REVISIONS: Revisions to this Agreement will be applicable to previous version of this Agreement. Revisions will be considered agreed to by the User continuing to use of or access the Service in any way. Peers reserves all rights for changes and/or modifications to the Service and rates and will communicate these changes to the subscriber within 30 days of their effect.

  10. GOVERNING LAW; CHOICE OF JURISDICTION. This Agreement will be interpreted and enforced in accordance with the laws of the Netherlands. User agrees to the exclusive jurisdiction of the courts of The Netherlands. August 2011, The Hague
